Defendant, John W. Meyers, Jr., was charged with distribution of a controlled dangerous substance, marijuana, a violation of LSA-R.S. 40:966 A(1), B(2). Defendant waived trial by jury and was found guilty as charged.

The defendant was given a five-year suspended sentence, five years probation, and the conditions of that probation were that he pay a $1000 fine plus court costs and serve two years in the parish prison. Defendant has appealed his...
