The defendant was convicted of second degree murder and sentenced to life imprisonment. The Court of Appeals reversed and remanded by 2-1 vote, concluding that the defendant should have been allowed to question prospective jurors on voir dire as to whether they could fairly consider the lesser included offense of manslaughter.
