BACKGROUND

This opinion deals with a petition for attorneys fees and expenses of litigation relating to the worst disaster in the history of the Commonwealth of Kentucky — and that was the May 28, 1977, fire at the Beverly Hills Supper Club in Southgate, Kentucky.1 The fire claimed 165 lives and injured another 116 employees and patrons.
