HUGHES, Justice (Retired).

Harold Russell has appealed his judgment of conviction of the offense of murder, see TEX.PENAL CODE ANN. sec. 19.02 (Vernon 1974), for which he was assessed twenty-five years in the Texas Department of Corrections.

We affirm.
