Suit was filed against a maker and two guarantors on two promissory notes, as an obligation that arose from a prior lawsuit with a convoluted "settlement" history. The defense to payment was failure to obtain a third party as co-maker, consequently invalidating the executed notes, and a challenge to the document delivery authority of the obligors' attorney.
