MEMORANDUM-DECISION AND ORDER

BARTELS, District Judge.

Theodore F. Johnson, a former car inspector with the New York City Transit Authority ("NYCTA"), commenced an action against the NYCTA and six NYCTA employees on or about March 25, 1983, alleging that the NYCTA and the six named employees had discriminated against him on the basis of race in violation of 42 U.S.C. § 1983, and in violation of the First, Fifth, Ninth, and Fourteenth Amendments
