OPINION

BURDOCK, Justice.

Appellant, Jackie Kia Floyd, was found guilty in a trial to the court of driving while intoxicated. TEX.REV.CIV.STAT. ANN. art. 6701-1(b) (Vernon Supp.1986). The trial court assessed his punishment at 60 days confinement, probated for two years, and a $450 fine.

We affirm.
