Roy Stone Transfer Corporation (Stone), a common carrier of freight, brought a civil action against the Budd Company, a truck trailer manufacturer, for damages resulting from its purchase of defective trailers from Budd Company. Stone filed the action in the Circuit Court of Henry County, Virginia, and the Budd Company removed to the federal district court pursuant to 28 U.S.C. § 1441.
