MEMORANDUM

TAURO, District Judge.

Petitioner in this case was convicted in Massachusetts state court of rape. He had two trials. The first was held in October 1979 and ended in a mistrial. Petitioner was convicted at the second trial, in February 1980. The Massachusetts Appeals Court affirmed the convictions. Commonwealth v. Sheffield, 16 Mass.App.Ct. 342, 451 N.E.2d 132
