OPINION

BRETT, Judge:

The appellant, Brian Mitchell Chambers, was charged in the District Court of Pawnee County, Case No. CRF-82-12, with First Degree Murder. The jury found him guilty of the lesser included offense of First Degree Manslaughter but could not agree on the punishment. The trial judge set the sentence at thirty (30) years' imprisonment.
