This motion for summary judgment, and cross-motion for summary judgment, require us once again to answer the question whether an indemnitee seeking indemnification after settling with a plaintiff, need only show potential liability in order to recover from the indemnitor. Because we reaffirm our holding in Hess Oil V.I. Corp. v. Firemen's Fund Ins. Co., 626 F.Supp. 882
