MEMORANDUM OPINION

LOVELL, District Judge.

Defendant was charged with two counts of allowing his cattle to trespass on forest lands, a violation of 36 C.F.R. § 261.7(a) and § 261.1(b). He waived jury trial and was tried to the court on May 6-7, 1986. After the close of the evidence, the Court received briefs from the parties, took the matter under advisement, and subsequently found the defendant guilty on both counts.
