OPINION

BENAVIDES, Justice.

Appellant was convicted of injuring an elderly person. TEX. PENAL CODE ANN. § 22.04 (Vernon Supp.1986). The trial court assessed punishment at twenty-five years in the Texas Department of Corrections.
