OPINION ON STATE'S PETITION FOR DISCRETIONARY REVIEW

MILLER, Judge.

Appellant was convicted of the misdemeanor offense of driving a motor vehicle in a public place while intoxicated. The jury found her guilty and assessed punishment at 30 days confinement in the Tarrant county Jail and a $500.00 fine. Appellant appealed her conviction to the Second Court of Appeals. That court reversed the conviction in a published opinion, Stone v. State,
