BURGESS, Justice.

Sidney James Romero was indicted for Aggravated Assault. On July 2, 1985, jury selection began and shortly after, appellant announced he wished to waive trial by jury. The trial judge interrogated appellant about his waiver and then released the jury panel. Thereafter, appellant plead "Not Guilty" to the court.
