This is an appeal from the granting of a Motion for Summary Judgment in favor of the appellee, Conoco, Inc. Conoco originally sued the appellant, John Norcross, on a suit on account. Conoco is the operator of several oil and gas wells located in Zapata County, Texas, and under its operating agreement, is responsible for charging and collecting expenses for operating the wells from the working interest owners.
