Defendant, Joseph Rousell was charged with forcible rape and found guilty as charged. R.S. 14:42.1. Rousell was sentenced to forty years at hard labor without benefit of parole, probation or suspension of sentence for the first two years. He was also ordered to pay $80 court cost or in default thereof to spend an additional thirty days in the custody of the Department of Corrections.
