SILBERMAN, Circuit Judge:

This case concerns the scope to be afforded Exemption 10 of the Government in the Sunshine Act, 5 U.S.C. § 552b(c)(10) (1982). The Sunshine Act generally requires federal agencies to open their meetings to the public; Exemption 10 provides, however, that an agency may close a meeting when, inter alia, it is likely to "specifically concern ... the agency's participation in a civil action...." Id.1
