The defendants have moved to dismiss the complaint against them pursuant to Fed.R.Civ.P. 12(b)(6). Plaintiff has filed a motion to strike in response. The Court finds that plaintiff's motion is wholly without merit and, therefore, that motion will be denied.1 The motion to dismiss will be treated as a motion for summary judgment in that the parties have been notified...
