This matter has been pending before the court for a lengthy period of time. In light of recent developments, specifically, decisions by two different courts, it becomes apparent that plaintiff's claims for relief herein are foreclosed. Accordingly, the defendants' motions for summary judgment are GRANTED in full, and this matter is DISMISSED.
