McNEILLY, Justice:

The defendant, David W. Dodson, was convicted following a jury trial in Sussex County of first degree felony murder and possession of a deadly weapon during the commission of a felony. When the jury refused to impose the death penalty, the defendant was sentenced to life imprisonment without probation or parole on the murder charge and to twenty years' imprisonment on the weapons charge.
