This is an appeal from a murder conviction in which the jury sentenced appellant to forty years' imprisonment.
On February 2, 1984, appellant, Richard Willmann, armed with a 16 gauge Winchester shotgun, shot and killed his brother, John Willmann, in the bedroom of appellant's home. The shooting ended a long-standing dispute over the administration of their parents' estate and other financial matters.
