SHORES, Justice.

We deny the Crabtreys' petition for writ of certiorari to the Court of Civil Appeals because they failed to follow Rules 39(c) and (d) of the Alabama Rules of Appellate Procedure. Our denial, however, does not mean that we necessarily agree with that court's construction of Code 1975, § 18-3-1.

WRIT DENIED.
