The heirs of Felicien Primeaux bring this appeal concerning the interpretation of a written instrument conveying the use of land to construct and operate a sugar refinery. The trial court ruled that the instrument was a contract of sale with a right of redemption from Felicien Primeaux to Erath Sugar Company, Ltd. (hereafter Erath), and sustained the peremptory exceptions of liberative prescription filed by Erath. The heirs raise the following issues...
