These consolidated cases involve a single vehicle accident which resulted in the death of the driver, Jack Maxwell. The defendant in both suits, the State of Louisiana, through the Department of Transportation & Development (DOTD), appealed from the trial court's determination that DOTD was 30 percent at fault in causing the accident, and from the calculation of the damage awards to Sheila and Carol Maxwell.
