This is primarily a case involving the tort of bad faith.

The defendant insurer denied the plaintiff insureds' claim for alleged wind damage to their mobile home, and the plaintiffs filed suit in the Marshall County Circuit Court for breach of contract and bad faith refusal to pay the claim.
