Salvador Lavandera appeals from his conviction in the Lakewood Municipal Court for theft in violation of R.C. 2913.02. The judgment of the trial court is reversed.

On February 8, 1985, appellant pulled his car up to an unmarked island of gasoline pumps at Detroit-Lake-wood Automotive, a Sunoco gasoline station. Lavandera had pumped 9.7 gallons of economy unleaded gasoline into his gas tank when he noticed that the price was $13.48. Appellant...
