LYNCH, J.

After a jury trial in the Superior Court the defendants, Charles S. Gliniewicz and John A. Durning, Jr., were each found guilty on two indictments charging assault and battery with a dangerous weapon, and one charging breaking and entering a building in the nighttime.2 They were each found not guilty on two indictments charging armed assault with intent to commit murder.
