Order unanimously modified on the law and as modified, affirmed without costs, in accordance with the following memorandum: In this action, plaintiff sued for fire damage to his barn, which he rented to defendant John Perry. While John Perry's son, William, and his son's friend, Scott Vigrass, were in the barn removing dirt from the gasoline tank of William's motorcycle, the motorcycle overturned, spilling gasoline.
