ORFINGER, Judge.

On August 11, 1977, four year old Joel Goode drowned in a man-made waterway or moat at Walt Disney World. He was with his mother, Marietta Goode, who noticed that he was missing shortly after 11 P.M. Approximately three hours later, Joel's body was found in five feet of water a short distance from where he had become separated from his mother. An autopsy found no evidence of foul play and established the cause of death as drowning. No one saw Joel...
