SINGLETON, Judge.

Steven Stiegele was charged with multiple counts of murder in the second degree, AS 11.41.110, and assault in the second degree, AS 11.41.210(a)(2). The state alleged that he drove his pickup truck off Eagle River Road and into the trees, killing three passengers, and seriously injuring a fourth.
