The order of the Appellate Division should be affirmed.

Defendant was arrested in his home November 18, 1980 and charged with two counts of assault, first degree, in connection with the shooting of Thelma Barnes. The arrest was made upon probable cause but without a warrant and thus was illegal under the subsequent decision of the United States Supreme Court in Payton v New York (
