The State appeals the dismissal of one count of first degree burglary and three counts of first degree kidnapping against defendant Danato Rand Rudy. The trial court dismissed those counts on the basis that the State prosecution following Rudy's federal conviction for conspiracy to violate 18 U.S.C. § 1951 (1982) (the Hobbs Act) was barred by the double jeopardy provisions of RCW 10.43.040.
