OPINION

TATUM, Judge.

This is an appeal by the State from a judgment dismissing an indictment charging the appellee with malicious stabbing. In dismissing the indictment, the trial court held that it was returned in violation of Rule 8(a), T.R.Cr.P. We concur with the trial judge and affirm the judgment of the trial court.
