Smurfit Diamond Packaging Corporation, which operates a paper mill in Middletown, Ohio, has filed a petition under 29 U.S.C. § 660(a) asking us to set aside portions of an order of the Occupational Safety & Health Review Commission that had the effect of affirming an Administrative Law Judge's decision to penalize Smurfit $150.00 for poor housekeeping.
