OPINION

NIERENGARTEN, Judge.

Respondent Juli-Ann Thompson commenced suit against appellant Douglas Hill under Minn.Stat. § 573.02 for the wrongful death of her husband, Dennis Ray Thompson. The case was bifurcated with the issues of liability and damages tried separately. The jury first returned a verdict finding Hill 60% negligent and Thompson (decedent) 40% negligent. The jury subsequently returned a verdict assessing Juli-Ann's damages at $318,000...
