The original suit sought to collect a deficiency of over $20,000.00 remaining on a promissory note executed by appellant Stavert Properties as principal obligor and appellants Joseph Akeroyd and Associated Haulers, Inc., as guarantors. Appellants filed a cross-action seeking damages for breach of a contract to extend the note for 180 days, for deceptive trade practices and for fraudulent and wrongful non-judicial foreclosure.
