Timmy Baker was charged in separate indictments for selling, furnishing, or giving away marijuana and cocaine, in violation of § 20-2-70, Code of Alabama 1975. These cases were consolidated for trial and the jury found the appellant "guilty as charged" in each case. Following a sentencing hearing the trial judge sentenced appellant under the split sentence act to one year in the penitentiary and three years...
