Defendant-appellant was found guilty in the Recorder's Court of DeKalb County of violating the DeKalb County alcoholic beverage ordinance, No. 7-2064, after his constitutional challenges to that ordinance were overruled. He has appealed directly to this court, and DeKalb County has moved to dismiss the appeal citing Henson v. DeKalb County,
