This case is before the Court on Cross Motions for Summary Judgment on a matter of statutory interpretation. Jurisdiction is proper pursuant to 28 U.S.C. § 1331, original actions under the constitution; § 1343(a)(3), original jurisdiction for 42 U.S.C. § 1983 actions; §§ 2201, 2202, and Fed.R.Civ.P.
