This is an appeal from a summary judgment entered in favor of appellees dismissing appellant's counterclaim and third-party complaints. We reverse and remand.

Appellee Baldwin National Bank (Bank) sued Taylor to collect monies owed the Bank by Taylor on a $40,000 unsecured promissory note that was approximately six months in default. Taylor's answer denied his indebtedness and included a counterclaim against the Bank and third-party complaints...
