The plaintiff, Michael Thomas Flagg (Flagg), brought this action under Title VII of the Civil Rights Act of 1964 against the Atchison, Topeka, and Sante Fe Railway Co. (the "Railroad"), and two of its employees, James Holmes (Holmes), and Fred Batliner (Batliner). Flagg, who is black, claims his discharge from the Railroad's employ was racially motivated.
