The plaintiff, Gary Caiani, owns and operates a 12' × 12' wood frame booth at the Walpole Mall (the "Mall") known as Gary's T-Shirt Shop. On November 26, 1982, detectives James Donahue and Scott Bushway of the Walpole Police Department conducted a search of Caiani and the premises at Gary's T-Shirt Shop.
