Robert Austin, the defendant, was charged by bill of information with two counts of armed robbery in violation of La.R.S. 14:64. One count was dismissed. A twelve member jury heard the case on March 5, 1984, and by unanimous verdict found defendant guilty of simple robbery, a violation of La.R.S. 14:65. On April 6, 1984, defendant was sentenced as a multiple offender to imprisonment at hard labor for five years. The defendant was sentenced immediately...
