Judgment modified, on the law, by vacating the sentence imposed upon the conviction for attempted robbery in the first degree and the determination that defendant is a persistent violent felony offender. As so modified, judgment affirmed and the matter is remitted to Criminal Term for a hearing and determination on the issue of whether defendant's prior 1972 conviction in the State of New Jersey satisfied the definition of a violent felony offense contained in the Penal Law...
