OPINION

SCOTT, Justice.

This is an appeal from an order for partial summary judgment issued by the district court of the Tenth Judicial District. There were extensive pretrial proceedings before various courts of that district. We recite only that procedure which is pertinent to this appeal. We reverse and remand.
