Johnny Applegate appeals from a judgment based upon a jury verdict involving his workers' compensation claim for a low back injury sustained while stocking at Safeway. The jury found that Applegate was injured in the course and scope of his employment on March 14, 1983, in Mount Pleasant, Titus County, Texas.
