Appellant Jerry Johnsen was convicted by a jury of murder in the second degree, Minn.Stat. § 609.19(1) (1982), for killing his estranged wife's lover. Johnsen admitted at trial that he was responsible for the death of the victim, but claimed that it was done in the heat of passion and that he was therefore only guilty of first degree manslaughter.
