Elon Nichols appeals from a judgment entered on a jury verdict in the Superior Court, Franklin County, convicting him of Gross Sexual Misconduct, 17-A M.R.S.A. § 253(1)(B) (1981). On appeal, he argues that the court erred in denying a motion for mistrial when evidence of prior similar conduct between the victim and defendant was heard by the jury, and in its jury instructions concerning absent witnesses and the right to subpoena witnesses.
