We are called upon to decide who should be required to pay the fee of an attorney appointed to represent an indigent parent in a child abandonment proceeding in the absence of a statute authorizing the fee or its payment. After a hearing, the family court dismissed the Department of Health and Human Resources' suit for a declaration of abandonment and ordered the department to pay the attorney's fee.
